Thanks for bringing that to our attention.
It is a vastly better piece than Spencer Overton's post at BlackProf.
Where it suffers most is the generous view that the minority of Tsalagi who undertook European agricultural model (male land ownership, chattel slavery) were somehow unlike their European-American counter-parts, yet economically competitive with them, or able to obtain and retain dominance in the Tsalagi polities prior to, and after, the Removal.
I wish the commenters would read both the majority opinion, and the dissenting opinion, in the case decided earlier this year, and would also focus on the political history of the CNO, from the 1940s to the present, or at least since the legal stand-off of only a few years ago, and do the numbers on voter registration, turn-out, and of course, "casino benefits".
