Exile in Canada (update)

Time to update the story about Jeremy Hinzman, his wife Nga Nguyen and their son Liam. now almost 2. I wrote about this in February, the link is Exile in Canada, again.

The Immigration and Refugee Board (IRB) hearing in Toronto for Jeremy Hinzman began this week. The hearing is open because Jeremy exercised his right under Canadian law that the IRB hearing be open. He commented that he feared that unless the process was transparent and all the testimony available to the Government, public and press, that Canadians would find his claim that an American could be entitled to protection by Canada as a political refugee to be a "preposterous proposition".

That's kind of hard to get my head around. The Elashi brothers were sent up the river by Ashcroft on a bogus charge simply because they ran the .iq top-level nameservers. The Detroit "sleeper cell" defendents were nearly sent up river by a career fink killed last October in Baghdad, and this is not an exhaustive list.

For the IRB to make an affirmative determination it needs to find


  • a liklihood of persecution for beliefs or legal conduct -- prosecution for failure to commit war crimes, an inherently wrongful prosecution, hence a persecution for beliefs or legal conduct.

This in turn requires a finding

  • of past and pending conduct and state of mind -- knowldge that the orders were illegal [1] and intent to disobey direct orders to commit war crimes.

Yesterday Jimmy Massey, discharged and therefore no longer subject to the UCMJ, testified at the IRB hearing on the prevalence of indiscriminant killing of civilians. The war crimes evidence is simply piling up.
